GENERAL TERMS AND CONDITIONS OF PURCHASE FOR THE SCROTIFY WEBSHOP
1. GENERAL AND COMPANY INFORMATION
1.1 These General Terms and Conditions (“Terms”) apply when you, as a consumer (“Private Person”) or trader (“Company”), place an order through the Skrotify.se webshop and related platforms (“Webshop”).
1.2 Contract concluded with the legal entity MM Washing AB (under name change to Skrotify AB), org.nr 559481-8857, Östra Storgatan 33A, 553 21 Jönköping (hereinafter referred to as “Skrotify”, “we”, “us”).
1.3 For private individuals, the Consumer Purchase Act (2022:260) and the Act on Distance Contracts and Off-premises Contracts (2005:59) apply. For Companies, the Sales Act (1990:931) applies, whereby these Terms and Conditions take precedence over dispositive law.
2. ORDER AND AGREEMENT
2.1 In order to shop in the Webshop, you must be at least 18 years of age. Minors require the consent of the guardian.
2.2 A binding purchase agreement is entered into only after Skrotify has confirmed the order by sending an order confirmation to the email address you provided.
2.3 We reserve the right to make final sales, any image and typographical errors on the Website (e.g. incorrect price information or product description) and that product images do not always accurately reflect the exact color or appearance of the goods. Skrotify reserves the right to correct any such errors and to change or update the information at any time.
3. PRICES AND PAYMENT
3.1 All prices are quoted in Swedish Kronor (SEK). For individuals, prices are shown including 25% VAT. For logged in Business customers, prices can be displayed excluding VAT.
3.2 The shopping cart displays the total price including VAT, shipping costs and any fees.
3.3 Payment is processed through our payment partner Stripe. We offer secure payments through the cards and payment methods presented at the checkout. Skrotify does not store any of its own card details.
3.4 By clicking on “Make Purchase” you agree to be liable for payment for your order.
4. PRODUCTION AND DELIVERY (Print-on-demand)
4.1 Large parts of our range are produced “on-demand” in cooperation with external partners (e.g. Printful). This means that the item is printed or manufactured only after you have placed your order, which reduces waste and is better for the environment.
4.2 Delivery time: Normal delivery time is [e.g. 5—10] working days, depending on the product and production queue. Skrotify is not responsible for delays caused by external shipping provider.
4.3 If a delivery is delayed beyond what was promised in writing and this does not depend on you, you as a Private Person have the right to cancel the purchase in accordance with the Consumer Purchase Act.
4.4 Unredeemed packages: For packages that are not picked up from agents, we charge a fee of 250 SEK (incl. VAT) to cover our costs for return shipping and administration.
5. RIGHT OF WITHDRAWAL AND RETURNS (Private individuals only)
5.1 As a Private Person, you are legally entitled to 14 days of withdrawal from the day you, or your agent, receive the goods.
5.2 Exceptions to the right of withdrawal: The right of withdrawal applies not for goods that have been manufactured according to your specific instructions or that have been given a distinct personal touch (e.g. custom printed merch with your name).
5.3 In order to exercise your right of withdrawal, you must notify our customer service (info@skrotify.se) within 14 days. The goods must then be returned to us within 14 days at the latest.
5.4 Condition and return shipping: The item should be returned in its original condition, unused and with any labels left. You are responsible for the return shipping and are responsible for the condition of the goods during the return transport.
5.5 Decrease in value: If the item has been handled to a greater extent than is necessary to determine its characteristics and function, Skrotify has the right to deduct a value reduction on the amount of the refund.
5.6 The right of withdrawal and open purchase does not apply to Corporate Customers.
6. COMPLAINTS
6.1 As a Private Individual, you have a 3-year right of complaint for original manufacturing defects. Complaints must be made within a reasonable time (two months is always considered reasonable) from the time the error was discovered.
6.2 In case of defective or faulty item, please contact us immediately at info@skrotify.se with a description of the defect and clear pictures of the product.
6.3 In the event of an approved complaint, Skrotify is responsible for the return shipping. In the first instance, we reserve the right to correct the defect or send a new defect-free item (re-delivery). If this is not possible, the purchase price will be refunded.
6.4 For Business Customers, complaints must be made in writing within eight (8) days from the time the defect was discovered or should have been discovered. Skrotify's liability to Corporate Customers is always limited to the purchase value of the goods.
7. PERSONAL DATA (GDPR)
7.1 In order to process your order and administer your purchase, we need to process your personal data. We protect your privacy. Full information about how we collect, process and share your data (for example with Stripe and Printful) can be found in our [Link: Privacy Policy].
8. FORCE MAJEURE AND LIMITATION OF LIABILITY (Corporate Clients)
8.1 Skrotify is not responsible for delays or non-performance caused by circumstances beyond our reasonable control (Force Majeure), such as strikes, natural disasters, wars, pandemics, government decisions or supplier disruptions.
8.2 In the event of purchases made by the Company, Skrotify shall in no event be liable for indirect damages, loss of profit, loss of production or similar financial losses.
9. APPLICABLE LAW AND DISPUTE
9.1 Swedish law applies to these terms and conditions and all purchases in the Webshop.
9.2 In the event of a dispute with a Private Person, we will comply with the decision of the General Complaints Board (ARN).
Allmänna Reklamationsnämnden, Box 174, 101 23 Stockholm, www.arn.se.
9.3 Disputes between Skrotify and Corporate Customers shall be finally settled by the Swedish General Court with the Jönköping District Court as the first instance.
