General Terms of Use and Privacy Policy for Skrotify Portal & App

By downloading, installing, accessing or using the Skrotify Portal and its associated applications (the “Service”), you agree to these General Terms of Use and our Privacy Policy in their entirety. If you do not accept the Terms, you may not use the Service.
PART 1: TERMS & CONDITIONS
1. Description of the Service
Skrotify Portal is a digital platform for managing scrap trade, booking related services (such as container rental and transportation) as well as an e-commerce platform (Webshop). The service also provides market information, price data and news. Certain parts of the Service (e.g. Webshop, Sell Scrap and Prices) are available to guest users, while full functionality requires a registered user account.
2. User Accounts and Roles
- Registration and Roles:
The service applies a role-based permission system. Your access to features is governed by the role assigned to you. Administrators (Admin) has the right to invite new users and assign roles. - Account responsibility:
You are responsible for keeping your login details confidential. Any activity that occurs through your account is deemed to have been carried out by you. - Accuracy of data:
You warrant that all information you provide when registering and conducting KYC processes is complete, true and up to date.
3. Use of the Service and Codes of Conduct
You agree to use the Service only for lawful purposes. The following is strictly prohibited:
- To upload, publish or transmit any material that is illegal, fraudulent, abusive or that infringes the rights of third parties.
- Manipulating the system, introducing malware (viruses, trojans), or disrupting the functionality of the Service.
- Providing misleading information about the origin, quality or weight of scrap in “Sell Scrap” requests.
- Responsibility for Uploaded Content:
You are solely responsible for all materials (texts, data, pictures in case of scrap request) that you upload to the Service. MM Rusting AB UÄ Skrotify AB reserves the right to delete content that violates these terms and conditions without notice.
4. Intellectual Property Rights
- Ownership:
MM Västi AB UÄ Skrotify AB owns all intellectual property rights to the Service, including but not limited to source code, design, texts, databases and trademarks. Skrotify® is a protected and registered trademark. - License:
You are granted a non-exclusive, non-transferable and revocable license to use the Service in accordance with these Terms. No ownership is transferred to you as a user.
5. Limitation of Liability and Disclaimers
- Pricing details:
The scrap prices and market data displayed in the Service are indicative and subject to change without notice. MM Västi AB UÄ Skrotify AB does not guarantee that prices are always updated daily no later than 09:30. The final price is always determined upon receipt and weighing/grading of the material. - Availability:
The service is provided on an “as is” basis. MM Rusting AB UÄ Skrotify AB does not guarantee that the Service will be uninterrupted or error-free, and is not responsible for any loss or damage arising from outages, glitches or network problems. - Indirect injuries:
Under no circumstances shall MM Rustak AB UÄ Skrotify AB be liable for indirect damages, loss of profit or loss of production.
6. Changes and Termination
- Changes:
MM Rusting AB UÄ Skrotify AB reserves the right to update these terms and conditions at any time. Substantial changes will be notified via the Service or by e-mail. - Shutdown:
We reserve the right to immediately suspend your account and deny access to the Service if we suspect a breach of these Terms, fraud, money laundering or other illegal activity.
7. Applicable Law and Dispute Resolution
These terms and conditions are governed by Swedish law. Any disputes arising out of these Terms and Conditions or the use of the Service shall be sought to be resolved amicably in the first instance. If this is not possible, the dispute shall be decided by the Swedish General Court, with the Jönköping District Court as the first instance.
PART 2: DATA PROTECTION AND PRIVACY POLICY (GDPR)
MM Västi AB UÄ Skrotify AB is the data controller for the processing of your personal data within the framework of the Service. We protect your privacy and handle your data in strict accordance with the EU General Data Protection Regulation (GDPR).
1. Collection of Personal Data
We collect and process the following categories of data:
- Account details:
Name, email, phone number, address, role, organization/social security number, and linked plant IDs (Plant). - ScrapInquiry:
Contact details, location data, data on metal types, photos of the material and desired dates. - E-commerce and Reservations:
Shipping address, products/services purchased and payment details (e.g. Stripe Session ID). - KYC data (Know Your Customer):
Comprehensive information for ID verification (via Stripe Identity), beneficial owner data, PEP (politically exposed person) status, source of funds and purpose of transactions. - Technical data:
IP address, device information, cookies and usage patterns.
2. Purpose and Legal Basis
We process your data based on the following legal bases:
- Performance of contracts:
To administer your account, manage scrap requests, process Webshop orders and book services. - Legal obligation:
To comply with the requirements of the Accounting Act and legislation regarding anti-money laundering and terrorist financing measures (KYC/AML). - Legitimate interest:
To analyze and improve the Service, prevent fraud and maintain system security. - Consent:
For subscription to newsletters, push notifications and placement of non-essential cookies. You can withdraw this consent at any time.
3. Recipients of Personal Data and Third Country Transfer
Your data may be shared with carefully selected sub-processors who help us operate the Service:
- Stripe:
For secure payment processing and regulatory KYC/ID verification. - Printful:
For the production and delivery of products from our Webshop. - Base44:
Our cloud and platform provider for storage and operations. - Authorities:
In case of suspicion of a crime or when required by law.
If we transfer data to suppliers outside the EU/EEA (a so-called third country), we ensure that the transfer is lawful by applying the European Commission's Standard Contractual Clauses (SCC) or other adequate safeguards.
4. Storage periods
We save your data only for as long as it is necessary for the respective purposes:
- Accounting and Transaction Data:
Saved for 7 years in accordance with the Accounting Act. - KYC Documentation:
Saved for at least 5 years after termination of the business relationship, in accordance with the Money Laundering Act. - Account details:
Saved as long as the account is active. In the event of inactivity or deletion, the data is deleted or anonymized, provided that no legal obligation requires continued storage.
5. Your Rights
According to the GDPR, you have the right to:
- Request a register extract of the personal data we hold about you.
- Get incorrect data corrected.
- Request deletion of your data (the “right to be forgotten”), in cases where the data is no longer needed or stored for legal reasons.
- Request restriction of, or object to, our processing of your data.
- Request data portability to transfer your data to another operator.
- File a complaint with the Privacy Protection Authority (IMY) if you believe that we are deficient in our handling.
6. Security measures
We apply strict technical and organizational measures, including encryption, role-based access controls (RBAC) and regular security audits, to protect your data from unauthorized access, loss or manipulation.
